These general conditions of sale govern all relations between the company Lutze Design Sàrl, publisher of the site www.ldx-graphics.ch (hereinafter “Lutze Design Sàrl”) and its customers.
Prior to any transaction, the customer acknowledges having read the general conditions of sale and expressly declares to accept them when he clicks on the “Validate” button on the virtual payment terminal, whether he pays by credit card, bank transfer or Paypal.
Usage
The products offered on this site are intended exclusively for people, companies, organizations, associations, communities, having a right to use a brand and its image.
Before ordering on this site, you must request a right of use from the owner of the brand.
The company Lutze Design Sàrl disclaims all responsibility for the use that the buyer may make of their order.
1. Special conditions of sale
The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on the screen (name, price, component, weight, quantity, color, particularities of the products, cost of home delivery and limitation of certain categories of products) and expressly declares to accept them without reservation. The placing of the order and its confirmation by the customer materializes his full acceptance of the special conditions of sale, which are the only ones applicable to the order.
1.2 Special case of personalized decoration kits
We require an order deposit, in the amount of 100 CHF, for the design of the model of the decorative kit. This deposit will then be deducted from the total invoice amount for the products purchased.
The deposit of 100 CHF for the personalized model is not refundable as long as one of our graphic designers has already designed a model.
Personalized decoration kits cannot be returned or exchanged.
1.3 Color/print rendering of deco kits
The display on the computer screen, smartphone or tablet is in RGB color, the digital prints of the decorative kits are in CMYK color. This difference in display and processing can give different color nuances and/or shine.
The fact that the color or final printed result is not identical to the display on your screen cannot give rise to a return of the product. It will therefore not be possible to make an exchange or obtain a refund due to a significant difference between the screen/print rendering.
2. Product sheets
Photographs (images) illustrating the products do not fall within the contractual scope. If errors are introduced, under no circumstances can Lutze Design Sàrl be held liable. The descriptive texts presented accompanying these photographs are given for information purposes only, they do not enter into the contractual scope and do not exempt from careful reading of the instructions provided by the manufacturer.
3. Order
The order is summarized including all the products selected by the customer, who validates it by clicking on the “Order confirmation” button.
4. Order confirmation
The company Lutze Design Sàrl reserves the right not to follow up on an order for any reason whatsoever, in particular relating to the supply of products, a problem concerning the order received (e.g.: illegible document), an abnormal order or a foreseeable problem concerning the delivery to be made.
In all cases, the company Lutze Design Sàrl will contact its customer if possible in order to keep them informed of developments in the order they have placed.
5. Shipping costs
Shipments are made by postal service in tracked parcels or by carrier. Shipping costs can be viewed on the site depending on the final destination.
In the event of delivery outside Swiss territory, the customer will also bear the taxes and customs duties relating to his country. Lutze Design Sàrl is under no circumstances required to check and inform the customer of applicable taxes and customs duties in this case. This verification is the responsibility of the customer.
6. Delivery
Delivery is made to the address indicated on the delivery note, completed by the buyer. The company Lutze Design Sàrl disclaims its liability for any failure to fulfill its contractual obligations in the event of force majeure or fortuitous circumstances, including, but not limited to, disasters, fires, internal or external strikes, internal or external failures or breakdowns, and generally any event not allowing the proper execution of orders.
The goods travel at the risk of the recipient. Always check your package upon arrival. You have 48 hours to make any reservations with the carrier in the event of something missing or damaged. The deadline for the Swiss Post is 8 days from the date of distribution, to go to the post office subsidiary to report the damage.
For reasons of availability (out of stock, stoppage of production, etc.) an order may be delivered in several installments to the customer who will only pay once the delivery costs displayed on the order form.
The offers on the site are within the limits of available stocks; in the case of products not stored on our premises, they are subject to availability from suppliers. In the event of unavailability, Lutze Design Sàrl can provide an equivalent product in terms of quality and price.
However, the company Lutze Design Sàrl undertakes to contact the customer before any action, or to reimburse the unavailable item(s) at the latest within 90 working days from receipt of the total payment for the order.
This reimbursement will be made in the form of a credit. Except in special cases, an order comprising several references, some of which are temporarily unavailable or permanently out of stock, can be shipped without the missing reference(s). In all cases, Lutze Design Sàrl will do everything possible to serve you as quickly as possible.
The company Lutze Design Sàrl reserves the right to modify without notice the shipping method chosen by the customer, depending on what it considers the most appropriate shipping method, upon simple request and if necessary it will reimburse the difference in the carrier’s price within 30 days from the date of the customer’s request.
6.1 Manufacturing and delivery times
Manufacturing times upon validation of the model are 3 to 15 days depending on the period.
The usual delivery times in Switzerland are 48 hours to 72 hours. These deadlines are given to you as an indication.
7. Right of withdrawal
The consumer has a withdrawal period of 7 days from receipt of the product (except custom-made items, see article 7.1). If the customer exercises his right of withdrawal, the company Lutze Design Sàrl undertakes to reimburse the sums paid after deduction of shipping costs within a maximum period of 30 days, after actual receipt by our services of the goods concerned, in good condition and in their original packaging. Return costs remain entirely your responsibility. The consumer can also choose to exchange the product.
7.1 Right of withdrawal made to measure item
For all our custom-made or personalized products, the right of withdrawal cannot apply. Therefore, no withdrawal period will be granted for made-to-measure or personalized items, all non-standard items and items with specific additions or modifications.
8. Price
Prices are inclusive of all taxes (VAT included) and are expressed in Swiss Francs. These prices do not include delivery costs. The prices indicated may change at any time without the liability of the company Lutze Design Sàrl being called into question. In all cases, the company Lutze Design Sàrl will inform its customer before proceeding with any transaction.
9. Logo
The company Lutze Design Sàrl / LDX Graphics will automatically sign all its creations with its logo affixed to the elements of its choice.
Your sponsors’ logos must be in vector format (.ai, .pdf, .eps, .svg, .jpeg or .png of good quality and sufficient resolution), otherwise the company Lutze Design Sàrl disclaims all liability in the event of a printing defect.
The company Lutze Design Sàrl / LDX Graphics declines all responsibility for requests for reproduction of logos protected by copyright. The use of a logo assumes that its owner authorizes you, and their use without authorization from their owner is under your entire responsibility.
10. Payment
The price invoiced to the customer is the price indicated by the online payment system or on the order form. The price of the products is payable in cash on the day of the actual order. Payment is made by VISA or MASTERCARD bank card, POSTCARD by bank transfer or by Paypal online, using secure payments set up by the company Lutze Design Sàrl. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement or the bank transfer has been made. Furthermore, the company Lutze Design Sàrl reserves the right to refuse any order from a customer with whom there is a dispute.
Payment data is encrypted when your payment is validated. This data is not kept by the company Lutze Design Sàrl.
11. Cancellation of order
Order cancellation can only be done on products available online and not on personalized products. In the event of cancellation by the customer, we reserve the right to charge from 20% to 80% of the amount of the canceled order, depending on the progress of the order unless the cancellation occurs within 7 days after the order, excluding orders for custom-made items (see paragraph 7.1).
In the event of cancellation by the company Lutze Design Sàrl, the amounts paid will be fully returned to the customer.
12. Disputes
This contract is subject to Swiss law. The company Lutze Design Sàrl cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction, misuse or misinterpretation of the use of the products marketed. Lutze Design Sàrl cannot be held responsible for any modifications made to products by manufacturers and distributors. The liability of the company Lutze Design Sàrl will be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the care taken in the development of this sales site.
In the event of a problem in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution. Please note that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee. It is also recalled that as a general rule and subject to the judgment of the courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer uses the products adequately.
Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution.
13. Warranty and Return
All products sold by the company Lutze Design Sàrl benefit from a guarantee (the duration of which varies depending on the product) granted by the manufacturer.
Only the manufacturer is responsible for the decision to repair, exchange or determine whether the problem falls under warranty. In the case of a defect falling within the scope of the guarantee offered by the manufacturer, and not resulting from misuse of the product, the customer will contact the company Lutze Design Sàrl in order to determine the procedure to be put in place. Any product that is incomplete, damaged or whose packaging is not that of the original cannot be covered under warranty.
Finally, the company Lutze Design Sàrl only guarantees the customer, for hidden defects that may affect the product sold and delivered, only in the context of the replacement of said defective product in whole or in part if only one or more parts were defective. Under no circumstances can the liability of the company Lutze Design Sàrl be recognized for possible damaging consequences (material, immaterial or bodily) due to the use of a defective product whose hidden defects are the cause.
No returns will be accepted without prior agreement from Lutze Design Sàrl. In addition, the customer must present the product accompanied by a description of the cause of the return for processing by after-sales service. Return transport of the product is at the customer’s expense and risk.
14. Reservation of title
The company Lutze Design Sàrl expressly reserves ownership of the products delivered until full payment of their price in principal and interest. The simple delivery of a payment document does not constitute payment. In the absence of full payment, the company Lutze Design Sàrl will be entitled to demand the return of the delivered equipment. The costs that may be incurred for this return will be the responsibility of the customer.
15. Rights assigned
It is recalled here for information purposes that according to the Intellectual Property Code, the moral right of a creation (including the right of disclosure, the right to respect the work and the right to withdrawal) is attached to its creator in a perpetual and imprescriptible manner. In fact, only the property rights as well as the right of representation and the right of exploitation will be transferred to the customer for personalized products (tailor-made decorative kits). The source file cannot be transmitted.
Finally, it is recalled that according to the same Intellectual Property Code, any representation or reproduction in whole or in part made without the consent of the author or his beneficiaries is illegal, and punishable according to the laws relating to the offense of counterfeiting. The same applies to translation, adaptation or transformation, arrangement or reproduction by any art or process.
16. Modifications to the conditions of Sale and Use
The company Lutze Design Sàrl reserves the right to modify or update these Conditions of Sale and Use of the site, at any time, without notice. The current version of these Conditions of Sale and Use of the site is displayed on the site from the date on which a modification takes effect. Continued use of the site, after a modification of the Conditions of Sale and Use of the site has taken place, constitutes acceptance on your part of this modification, it being understood that the version of the Conditions of Sale and Use applicable to your reservation or purchase of product or service, is that in force on the day of this reservation or purchase.
17. Legal information and confidentiality
The need to have personal information collected for distance sales purposes is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and guarantees. Failure to provide information will result in the order being invalid. We are at your disposal to find the simplest and most satisfactory solution possible for all parties.
18. Data protection / Cookies
As part of the operation of the site www.ldx-graphics.ch, Lutze Design Sàrl may collect personal data. This data will be processed in accordance with the Swiss Federal Data Protection Law 235.1.
19. Applicable law and legal forum
The applicable law is Swiss law, and any dispute will be handled by the Broye and Nord Vaudois District Court.
